The court of appeals affirmed in part and reversed in part a judgment of the district court and remanded. The court held that under controlling law, a tenured professor’s pamphlet concerning the future of the state university where he worked addressed matters of public concern. The court held further that the rule of Garcetti v. Ceballos, 547 U.S. 410 (2006), denying First Amendment protection to statements made by public employees pursuant to their official duties, does not apply to speech related to scholarship or teaching.
