The First Appellate District granted a petition for writ of mandate. The court held that a trial court considering a defendant’s motion to dismiss for violation of his or her federal constitutional right to a speedy trial must expressly weigh the four factors set forth in Barker v. Wingo (1972) 407 U.S. 514, even in the absence of any justification for the delay.
