The court of appeals reversed a district court judgment of dismissal. The court held that a school uniform policy compelled speech for First Amendment purposes where it mandated the written motto, “Tomorrow’s Leaders,” on uniform shirts. The court held further that the school uniform policy employed a content-based exemption where it allowed students to wear instead uniforms of “nationally recognized youth organizations such as Boy Scouts and Girl Scouts on regular meeting days.”
