The court of appeals reversed a judgment denying a death row inmate’s petition for writ of habeas corpus and remanded with instructions to grant the write. The court held in an amended opinion that a California trial court committed federal constitutional error by excluding both the defendant and his attorney from closed in camera hearings at which the prosecution presented, and the trial court assessed the legitimacy of, justifications for the exercise of peremptory challenges as to all African-American and Hispanic jurors on the panel.
