The court of appeals affirmed a district court order modifying a defendant’s conditions of supervised release. The court held that a district court may impose a sexual deviancy evaluation as a condition of supervised release even when deviant sexual conduct was not an element of the underlying crime of conviction. The court held further that the government need not prove a change in circumstances since the original supervised release conditions were imposed in order to justify such an additional condition.
