The Third Appellate District affirmed in part and reversed in part a judgment and granted petitions for writ of mandate and prohibition. The court held that a statutory scheme that purported to allow the State to invade private property temporarily, for purposes of assessing the property’s suitability for eventual condemnation for a proposed development project, unconstitutionally deprived the affected landowners of the protections that would be afforded them in a condemnation action.
