The Fourth Appellate District reversed a judgment. The court held that the mere presence of a defendant’s DNA on a rock that was purportedly used to effect entry to the scene of a burglary was insufficient to support his conviction in the absence of any evidence that the defendant’s contact with the rock could only have occurred during his commission of the crime.
