The court of appeals affirmed a district court’s denial of habeas relief. The court held that a state court reasonably determined that a mid-trial conversation between a court bailiff and a criminal defendant did not constitute an interrogation that required a (I)Miranda(I) warning. The court held further that the Antiterrorism and Effective Death Penalty Act of 1996 standard of review could not be waived by the government’s failure to address the standard of review in its briefing.
