The court of appeals affirmed a district court judgment of conviction in part, vacated the defendant’s sentence, and remanded the action for resentencing. The court held that a stipulated removal proceeding violated an alien’s right to due process where it waived the alien’s right to appeal the removal order. The court held further that an immigration judge committed a regulatory violation by finding that the alien’s waiver of rights was voluntary, knowing, and intelligent solely on the basis of the alien’s signed stipulated removal form.
