The court of appeals reversed an order of the district court and remanded. The court held that a misstated jury instruction advising that an honest but “reasonable” belief in the need for self-defense did not negate malice reduced a state’s burden for convicting a defendant of murder instead of voluntary manslaughter, an error that was prejudicial.
