The U.S. Supreme Court vacated a judgment of the U.S. Court of Appeals for the Fifth Circuit and remanded the action for further proceedings. The court held that the Fifth Circuit misapprehended summary judgment standards in a federal civil rights action when it credited a police officer’s evidence in support of a qualified immunity defense while failing to acknowledge and credit key counter-evidence proffered by an injured plaintiff.
