Justice Mark Simons listened intently as a deputy AG made the case to disqualify a tow truck driver from the California Highway Patrol's rotation system. The man lost his spot by pleading no contest to a misdemeanor assault charge, which violated the state Vehicle Code. Simons suddenly stopped her, pointing out that one section of the code says a driver can be disqualified if convicted of a crime, while another requires it to be a felony. It was a classic gotcha moment -- and classic Simons.
