The Second Appellate District reversed a judgment with directions. The court held in the published portion of its opinion that a party was not entitled to mandatory relief from his untimely opposition and motion to enforce a settlement agreement where neither fell within the attorney-fault provision of the statute governing relief from entry of a default.

A dispute arose between Kazi Shadat Hossain and Mohammed Jamshed Hossain regarding their partnership for the operation of a hotel. Kazi and Jamshed signed an agreement that provided for dissolution of the partnership. The two later mediated a further agreement that Kazi would sell his interest to Jamshed.
