The Fourth Appellate District affirmed a judgment of the trial court. The court held that the date of valuation of condemned property was properly changed from the date of deposit of probable compensation to the date of trial where under the unique circumstances of the case it comported with the constitutional requirement of just compensation.
In September 2001, San Diego Metropolitan Transit Development Board (MTDB) complained in eminent domain to acquire a portion of property owned by RV Communities (RV) for construction of a trolley line. RV was using the property as a recreational vehicle resort.
