The First Appellate District denied a petition for writ of prohibition. The court held that, under Proposition 69, all misdemeanants who must register as sex offenders are required to provide DNA samples without regard to whether the conviction triggering the registration requirement occurred before or after the proposition’s 2004 passage.
Sylver Dean Good was convicted of the misdemeanor crime of indecent exposure in 1996. The conviction resulted in Good’s lifetime obligation to annually register as a sex offender under Penal Code �290.
