Most IP lawyers are pleased with the rules and say the changes are tweaks in the right direction. Several said that Judge Ronald Whyte’s presence on the committee, in particular, gave them confidence. Still, everyone will be watching for how judges rule on good-cause arguments in the next few months.
“As long as the judges are open-minded, I think it’s a good change,” said Barkan.
