Suit for delayed diagnosis yields $28.9M award

A jury awarded $28.9 million to a patient who claimed a delayed diagnosis of Wilson's disease resulted in severe brain damage. In 2012, Emilee Williams, then 21, went to Dr. Elene Pilapil for tremors, difficulty concentrating and panic attacks. Eight months later an MRI showed severe damage to her basil ganglia due to Wilson's disease. The plaintiff's expert neurologist testified that Wilson's disease is treatable, but must be treated at the most immediate time possible in order to achieve a better outcome and avoid catastrophic decline. The defense argued that Pilapil was appropriately treating the plaintiff for anxiety and depression.

Teen passenger paralyzed in crash awarded $28.7M

A jury awarded $28.7 million to a teenage passenger who was rendered a quadriplegic when her car collided with an Ely School District bus. In 2009, Paige Anderson, then 16, was in the back seat of a sedan driven by a teenage friend when it was broadsided by the bus, dragging the car about 100 feet. Plaintiff's counsel argued that both drivers were to blame for the accident due to their inattention. Counsel argued that the bus driver was also speeding. Defense counsel for the school district argued that the teen driver, Anderson and the other passengers were texting. Phone records showed that the driver had been texting up until the moments in which the collision occurred. The jury found the bus driver 10 percent negligent and Anderson's driver 90 negligent.

State labor director gets $2M on discrimination claims

A former director for the state Division of Employment Security agreed to a $2 million settlement on her claims that she faced age and gender discrimination before she was fired. Gracia Yancey Backer claimed that younger male employees were given preferential treatment and she was pressured to retire from her position. She claimed that her complaints about the director of the labor department were ignored and her termination was retaliatory.
