Years of exposure to asbestos caused painful death: estate

The estate of a man who died from mesothelioma was awarded $32.7 million against an insulation manufacturer. Franklin Delenor Finch had worked at a Firestone plant for 20 years. It was during that time that he was allegedly exposed to asbestos contained in insulation. Finch, who died after suit was filed, claimed Covil Corp. was responsible for manufacturing the asbestos-containing insulation. Other entities had been sued, but were dismissed prior to trial. The case proceeded to trial against Covil only. Covil claimed it no longer sold significant amounts of asbestos insulation to the Firestone facility when Finch worked there. Covil also argued that other manufacturers were responsible for Finch’s exposure to asbestos.

Plaintiff’s failure to yield led to intersection crash: defense

A defense verdict was entered in a motor vehicle case stemming from an intersection collision. The accident occurred when Eddie Lee Foster, Sr. entered the intersection of Ellis Ferry Avenue and Floyd Baker Boulevard. Foster alleged that Lesa Michelle Humphries entered the same intersection without stopping for a red light and struck the driver’s side of Foster’s car. Foster asserted that he suffered soft tissue neck and back injuries in the crash. Humphries had denied running a red light and claimed the light was yellow when she entered the intersection. The jury reportedly determined that Foster failed to prove by the greater weight of evidence that Humphries was negligent.

Former paper mill worker’s death was due to asbestos: suit

A jury awarded $700,000 in a products liability wrongful death suit to the estate of a man who died from mesothelioma. The lawsuit alleged that Steven Redfearn Stewart was exposed to asbestos-containing products during his work in a paper mill over a 40-year period, which led to Stewart developing mesothelioma. A number of entities were sued, but the only defendant remaining at trial was Scapa Waycross, Inc. According to Stewart’s estate, Scapa Waycross manufactured products used at the paper mill that contained asbestos and failed to adequately warn of the danger of working with these materials. Scapa Waycross denied that Stewart was exposed to asbestos-containing products and also denied liability for any injury to Stewart.
