“Expensive, bitter, time‐consuming and hard‐fought.” That's how a federal judge in Miami described a $380 million antitrust battle between two pharmaceutical manufacturing and marketing companies.

Last week, Cooley lawyers led by partners Michael Klisch and Robert Cahill came out on top on behalf of client Patheon Inc., getting the 3-year-old case dismissed on summary judgment.

Patheon was sued in U.S. District Court in the Southern District of Florida by Procaps SA. The two companies teamed up in 2012 to develop, manufacture and market softgel capsules for prescription drugs.
