Boies Firm Wins Skirmish Over Adelphia's Special Examiner Request

The judge presiding over Adelphia Communications' bankruptcy has denied a request to appoint a special examiner to determine whether Boies, Schiller & Flexner violated the bankruptcy code by failing to disclose that some of its lawyers, including children of senior partner David Boies, were financially interested in litigation support companies the firm recommended to Adelphia. The cable TV company had asked Boies Schiller to resign as special litigation counsel for failing to disclose those interests.

Investor Ronald Katz hired the law firm to represent him in connection with a $3 million investment in a company called Humitech. Katz claims the lawyers failed to determine that Humitech was not the beneficial owner of certain mineral rights he expected to obtain, and that other collateral in the form of stocks was encumbered.
