CDO Claims Against Goldman Founder on 'Sophisticated Investor' Defense at Second Circuit

For the second time in under a month, an appellate panel in New York has thrown out claims by a German bank that alleged it was duped into investing in a CDO stuffed with risky mortgage-backed assets. And in both cases, the appellate rulings confirmed that it's going to be an uphill battle for big sophisticated investors who cried foul over complex securities deals to force defendants to pay up.
