Eliot Spitzer said he wants to review the state Constitution's 150-year-old mandate that most judges retire at the end of the year in which they turn 70. Just after attending a swearing-in ceremony Monday for Chief Judge Judith S. Kaye to a term that will end when she is forced to step down on Dec. 31, 2008, Spitzer said in an interview that leaders in private industries and professions "are wondering whether rules of that sort make any sense."

High Court Denies Attorney Fees to Challenger in Class ActionBrushing aside an 1891 precedent, the New York Court of Appeals on Thursday said lawyers who successfully challenge class counsel fees on behalf of individual plaintiffs are not entitled to reimbursement for their fees. The majority in a 5-2 decision held that "comprehensive" 1975 reforms to class actions in New York by the state Legislature authorized payment of fees only to the "representatives of the class" and not the "award of counsel fees to any party, individual or counsel, other than class counsel."
