Trying To Fit Square Pegs Into Round Holes

Occasionally I have been questioned/challenged/called out as to whether the Rules of Professional Conduct ought to apply to government lawyers. Good question. My best answer is "maybe," but I am not sure.

Opinion: Texting For Business

In law school, I tried to fulfill my upper class writing requirement by proposing a paper examining the brand new concept of lawyer advertising. Bates v. Arizona was decided the year I graduated.

Disruptive Technology Leads To Death By Small Cuts

I had an interesting talk with New Milford solo Greg Cava the other day. Greg is past chair of the Connecticut Bar Associaton Real Property Section and has been one of the most vocal proponents of lawyers taking a more aggressive posture with regard to defending the practice of law from out-of-state law firms, Internet enterprises and others who have been chipping away at the bread and butter of the small and mid-sized law firms for many years.

Opinion: Opacity Has A Purpose

I saw a post on an ethics listserv the other day about a proposal by the California disciplinary counsel to issue a "consumer alert" any time a lawyer is accused of misappropriating client funds. Under the present regime, these alerts are sent out after an investigation reveals misappropriation of over $25,000.

Guns And Mental Health

In the wake of the Newtown tragedy, many will seek answers and solutions. Unfortunately, they will be joined by the predictable rabble of attention getters, including some members of our profession, who will use this chance to promote themselves, "calling for" this or that, but really only trolling for clients and promoting their businesses. We all know who they are.

Criminalizing Bad Behavior Often Not A Good Idea

Dharun Ravi, the young man who was tried and convicted of a hate crime related to the suicide of his roommate at Rutgers, recently was sentenced to 30 days in jail. It was an unsatisfying ending to a prosecution that probably should have never been brought. I doubt anyone is happy with the outcome.

Judge Droney And Other Year-End Thoughts

As the year winds (grinds?) to an end, I am emptying the jar in which I keep all the topics I meant to write on. Of course, every time I think there is nothing new to say, another crazy case comes under the door or over the transom (though these days, it is usually by e-mail) and I marvel at the complexity of life and the creativity of our brethren when they stray from the path. So here are a few short thoughts for the end of the year.
