In his Financing column, Jeffrey Steiner warns mortgage lenders not to not rely on assignments of leases and rents, whether as a clause in the mortgage or as a separate agreement, to protect their interests in the income from their collateral prior to the appointment of a receiver or the final sale of the property at foreclosure. Recent Developments in Neighbor Litigation

In their Construction Law column, Kenneth M. Block and Joshua M. Levy write: Where a developer finds an uncooperative neighbor, recourse is available through Real Property Actions and Proceedings Law Section 881, pursuant to which the developer may obtain a license to enter the neighbor's property.
