Ninth Circuit Reverses on Whistle-Blowers' SOX claim

The Ninth Circuit, in its first examination of the whistle-blower protections under Sarbanes-Oxley, revived the lawsuit of two in-house attorneys who'd sued their former employer for wrongful termination. The court ruled that the lawyers, who claimed they were fired in retaliation for raising fraud claims, did not have to prove fraud occurred at their company. Rather, they only needed to demonstrate that they believed fraud occurred.

Drugmaker Wyeth on Wednesday sued regulators at the FDA in an attempt to block the sale of a recently approved generic version of its intravenous antibiotic Zosyn.
