A federal judge in Georgia has sided with a defendant accused of fraud in a RICO case filed by a builder, finding the plaintiff misinterpreted a crucial legal standard.

Judge Michael J. Brown of the U.S. District Court for the Northern District of Georgia granted defendant West Shore Walden's motion to dismiss racketeering claims, as well as its motion for sanctions, and denied as moot the plaintiffs' motion for expedited discovery.
