The Superior Court of Fulton County has tossed three more counts in the election interference indictments against Former President Donald Trump, former attorney John Eastman, and other defendants after finding the charges lie beyond state jurisdiction, leaving 32 counts standing including an overall RICO charge.

On Sep. 12, Fulton County Superior Court Judge Scott F. McAfee granted in part a motion to dismiss filed by Georgia state Sen. Shawn Still and attorney John Eastman, defendants accused of meddling in the 2021 presidential election. The three counts, two of which were against Trump specifically, involved perjury and false filings in federal court, were preempted by federal statutes under the Supremacy Clause, according to McAfee.
