Under the Americans With Disabilities Act, "reassignment" to an open and available position must be considered as a possible "reasonable accommodation." Attorney Sid Steinberg notes that the 8th Circuit significantly narrowed the scope of an employer's "reassignment" obligation by holding that the employer need only "consider" an accommodated employee for a position, but may still choose a more qualified candidate.
