Vice Chancellor Sam Glasscock III decided Thursday not to stop a former Hub Group Inc. executive from taking another job, stating that the transportation and logistics company hadn’t convinced him it would be able to prove the contract enforceable at trial.

The denial of Hub Group’s preliminary injunction, a win for the Richards, Layton & Finger attorneys who represented former company Vice President Christopher Knoll, marks the third time since the beginning of 2023 that the emphatically pro-contract court has declined to enforce some type of anticompetitive agreement, an area in which Delaware stands to make a significant national impact in future decisions.
