The Delaware Supreme Court has considered multiple cases this year involving non-compete agreements, but it's answers to certified questions from the Court of Appeals for the Seventh Circuit could have the most widespread effect yet.
On Oct. 9, the justices heard argument over just how far a decision the court issued earlier this year can be applied, with an employer claiming it should extend to virtually all forfeiture for competition agreements and a former employee arguing it should only apply in limited partnerships.
