The Delaware Supreme Court has ruled that its decision in Cantor Fitzgerald v. Ainslie may be applied in situations that don't involve a limited partnership provision, resolving certified questions submitted to the state appellate court by the U.S. Court of Appeals for the Seventh Circuit.

The Supreme Court heard arguments in October on whether Cantor Fitzgerald, which was decided in January, requires a court to defer to the contractual language of forfeiture for competition provisions only in the context of a limited partnership, or if other types of agreements also bar courts from looking at their reasonableness.
