Inexpensive remedies at any price? The issues around 'DIY freezing orders'

Suppose someone in another European Union member state – say, Bulgaria – owes a friend of yours £3,000. He says that he is going to do everything he can to avoid your friend getting his money. You could tell your friend about the worldwide freezing injunction available in the courts of this country. You could tell him that Bulgaria may assist your friend's action by granting their own domestic injunction against the debtor pursuant to article 31 of the Brussels Regulation. Or you could just be realistic and tell him that, for the sake of £3,000, he is priced out of the international injunction market. Perhaps he should just let it go. After all, life's not fair.

Criminal silks could see a significant drop in pay to match the rates of leading junior barristers, following recommendations made by the Legal Services Commission (LSC) last week. At a meeting between the LSC and Criminal Bar Association (CBA) last week, the LSC outlined plans to overhaul the current pay system for the criminal Bar, including a proposal that could see barristers remunerated in line with the new Quality Assurance Scheme for Advocates (QASA) instead of the current Advocate Graduated Fee Scheme (AGFS).

MoJ pushes for increased take-up of mediation with £10m budget injection

The Ministry of Justice (MoJ) will add £10m to the UK's publicly funded mediation budget next year as part of an effort to promote the use of mediation over litigation. According to the MoJ's 2010-11 annual report, an extra £10m will be added to the mediation budget as of April 2012, taking the total allocated amount to £24m.

Freshfields Bruckhaus Deringer has hired former Berwin Leighton Paisner (BLP) Russia dispute resolution chief Maxim Kulkov to head up its Moscow litigation practice as part of a wider strategy to strengthen the firm's disputes practice internationally. The magic circle firm has identified Russia, Asia, the Middle East and the US as key areas where it wants to expand its litigation practice in response to growing demand from existing clients and in order to capture new work. Including Kulkov, Freshfields has four disputes lawyers in Russia and this figure is expected to double over the next three years, with similar expansion planned in Asia, where the firm currently has three partners.
