Boston lawyer's fight over indigent legal fees kicked to federal court

The 1st U.S. Circuit Court of Appeals recently ruled that a Boston lawyer's case over reimbursement of his legal fees against officials of a state agency that assigns lawyers to indigent litigants should be decided in federal court. Daniel Batterman, a solo practitioner who representings indigent children and parents for the Massachusetts Committee for Public Counsel Services, sued committee officials over unpaid reimbursement for his work.

Defunct Kentucky law school files bankruptcy papers

A defunct Kentucky law school has run into legal troubles — again. The American Justice School of Law in Paducah, Ky., on Sept. 23 filed bankruptcy papers, listing the entity's assets at $1.6 million and its debts at $5.2 million. Attorney Alan Stout, who filed the petition in the U.S. Bankruptcy Court for the Western District of Kentucky for the law school, said he expects the amount of debt to increase to about $6 million.

California Gov. Arnold Schwarzenegger has signed 131 of the 140 pieces of legislation that had been on hold pending the resolution of his protracted budget negotiations with the state Legislature, including two that affect personal injury lawsuits. One piece of compromise legislation, Assembly Bill 83, protects people who are not in the medical profession from being sued after they help someone at the scene of an accident, unless their actions rise to the level of gross negligence or recklessness.
