A three-judge panel of the U.S. Court of Appeals for the Second Circuit on Thursday affirmed the dismissal of a RICO lawsuit involving a Luxembourg-based real estate development company, ruling that the district judge "properly considered all three steps of the forum-non-conveniens analysis" before she decided to dismiss the case.

Boies Schiller Flexner managing partner Matthew Schwartz is the lead attorney for Kingstown Capital Management and related entities, which sought more than $1 billion in damages in the suit and argued that it was different from the matter filed in Luxembourg.
