Overtime Suit Joins N.Y., Federal Claims

Immigrant workers at a Brooklyn bakery can sue for overtime violations under state law as passive class members even though a parallel federal statute would require them to affirmatively "opt in" to a class action, a federal judge has ruled. Because immigrant workers may be reluctant to assert their legal rights for fear of retaliation, Eastern District Judge John Gleeson found that the more restrictive federal rule may not be invoked to bar him from considering claims under state law.
