In 2004, appellant Corsicana Industrial Foundation sought to develop a retail center on its land and it entered into separate agreements with appellee city and appellee county.

Defendant was entitled to summary judgment in plaintiffs' common law fraud and Unfair Trade Practices and Consumer Protection Law action over denial of a mortgage application because the UTPCPL claim failed since plaintiffs did not purchase anything from defendant and plaintiffs failed to establish damages or any misrepresentation to support the fraud claim. Motion granted.

Defendant moved for summary judgment in action over plaintiff's fall over a pallet in the store and court found defendant owed no duty to plaintiff because the pallet was an objectively obvious danger, no party argued the assumption of risk doctrine in this summary judgment context, and plaintiff's subjective apprehension of the danger of the pallet was not relevant.
