Court Denies Defendant's Motion to Dismiss Strict Foreclosure where EMAP Notice Requirements Not Met

Appellant Craig Price was an employee of appellee Valvoline, LLC. As a part of employment with appellee, employees were assessed points for absences not related to COVID-19.

Defendant moved to strike or open a landlord's default judgment against him as a purported tenant at the landlord's property. The court denied the motion to strike but granted the motion to open judgment where defendant credibly testified he petitioned to reopen the matter promptly after learning of plaintiff's default judgment against him and was able to retain counsel, and he had an ostensibly meritorious defense.

Trial court erred in failing to hold an evidentiary hearing to resolve taxpayer's claims of assessment board negligence in sending notice of an assessment increase before denying taxpayer's petition for leave to appeal nunc pro tunc. Order of the trial court vacated and remanded.
