Superior court erred in vacating stay of arbitration of challenge to LP's special litigation committee determination where such determinations had to be reviewed by the courts pursuant to Pennsylvania Uniform Limited Partnership Act and the partnership agreement expressly stated that it was to be construed under Pennsylvania law. Order of the superior court reversed, case remanded.
In the Matter of Andrew YY. v. Gabriela XX.
The court made the following rulings on the parties' motions in limine: (1) it suppressed evidence that two prosecution witnesses submitted to polygraph examinations and a computer voice stress analyzer test and their answers were deemed deceptive; (2) statements made by defendant in prison to a fellow inmate were admissible; and (3) defendant's requested impeachment of investigators with questions they posed to him during his post-arrest interrogation that had previously been suppressed was not ripe until the time of trial.
Defendants appealed the court's order denying their motion for judgment on the pleadings in plaintiff's action alleging sexual abuse by a teacher. The court concluded that its order should be affirmed where defendants' immunity under the Political Subdivision Tort Claims Act was subject to retroactive application of the Sexual Abuse exception enacted by the legislature in 2019.
