"The balancing act between the need for immediate apprehension, particularly when the car has a GPS and is running low on gas versus potential harm immediately to the public. That balancing test is fairly easy to do in this case. There has to be an adult in the room, and the adult in the room has to be the police department. This pursuit should have never started in the first place, and it should have been shut down long before the time that this incident occurred."
