    Post-'Jevic,' Expansive Interpretation by Bankruptcy Courts Possible

    In our last column we reported on the U.S. Supreme Court's decision in Czyzewski v. Jevic Holding, 137 S. Ct. 973 (2017). In that decision, the court ruled a bankruptcy court may not order a structured dismissal of a Chapter 11 case that provides for estate assets to be distributed in violation of the Bankruptcy Code's distribution scheme. The decision was widely discussed by bankruptcy practitioners, in part because there are a number of common practices in Chapter 11 that also distribute estate assets in violation of the bankruptcy code's distribution scheme.

    On June 7, new IRS regulations that change the way state and local governments issue tax-exempt bonds went into effect. The new rules change the way municipal issuers determine the issue price of tax-exempt bonds they issue, and amend existing IRS regulations under Section 148 of the Internal Revenue Code.

    You Received a Notice of Removal to Federal Court—Now What?

    To the practitioner who spends most of his time litigating in the state courts, removal to federal court may by an infrequent event, and the receipt of a notice of removal might cause some unease because of unfamiliarity with the mechanics and underlying law. Whether the practitioner is seeking to remove a case to federal court, or attempting to have it remanded, the obvious place to start, of course, is the statute governing removal, which is found at 28 U.S. C. Section 1441.

    Digital Evidence: Federal Rules and Common Sense, Part II

    Examination of the court's opinion reveals questionable reasoning as to a few key issues. The first issue is one not addressed: standing. Assuming that the plaintiff actually did use the "find my iPhone" application to locate the iPhone at the defendant's residence, and that the application worked properly—it is odd that the phone would be at that location, as opposed to OSCO's evidence locker—it is hard to see what reasonable expectation of privacy, under the Fourth and Fourteenth amendments or any federal or state statutes (none were cited), the plaintiff would have in a phone which was initially in the possession of the plaintiff's fiancé and was thereafter in the possession of OSCO and the defendant.
