On Dec. 5, 2018, plaintiff Sue Beckhold, 65, a pharmacy delivery person, was stopped behind a school bus on Walnut Bottom Road in Cumberland. The rear of her sedan was struck by the front of a Rabbit Transit bus. Beckhold claimed head injuries.

On Jan. 21, 2021, plaintiff Charles English, 50, a truck driver, was driving east on Interstate 80 in Luzerne County. The rear of his flatbed truck was struck by the front of a tractor-trailer driven by Christopher Childs, of Fraley & Schilling Inc. The accident occurred during an active snowstorm with ice on the roads. English claimed shoulder injuries.

The Pennsylvania Superior Court concluded that the evidence presented in the automobile accident case failed to establish a foundation for a sudden emergency instruction. The plaintiffs were entitled to their requested instructions on a driver's duty of care. Finding prejudicial error in the court below, the Superior Court reversed and remanded for a new trial.
