On Sept. 26, the New Jersey Supreme Court issued a watershed decision in NJDEP v. Dimant, clarifying the nexus standard under the Spill Compensation and Control Act. The court drew important legal distinctions between finding that a party discharged a hazardous substance and determining that a party is liable for cleanup and removal costs.

A three-judge panel of a Florida Appellate court had ruled that damages in the case must be considered one smoker at a time, ending the risk of a huge punitive damage award. On Friday, the court tossed out the order. After hearing oral arguments, the appeals court will issue a new ruling on Sept. 30.
