The tobacco industry may have celebrated prematurely a few weeks ago, when it won a major victory in the Miami class-action suit brought by smokers who claim cigarettes made them ill. A three-judge panel of a Florida Appellate court had ruled that damages in the case must be considered one smoker at a time, ending the risk of a huge punitive damage award. On Friday, the court tossed out the order. After hearing oral arguments, the appeals court will issue a new ruling on Sept. 30.
