3rd Circuit Finds SGL Abused Chapter 11 Filing

In a warning to corporations plagued by litigation woes, the 3rd U.S. Circuit Court of Appeals ruled SGL Carbon AG misused U.S. bankruptcy laws when a financially healthy unit filed for Chapter 11 protection to prod customers into settling antitrust lawsuits. The court concluded that SGL Carbon Corp., SGL Carbon's U.S. arm, filed for bankruptcy to gain leverage in antitrust suits alleging the company engaged in price fixing, rather than filing to reorganize to address business problems.

A Louisiana appeals court has revived a civil suit brought by a receptionist against the law firm where she used to work and where she alleged that she was raped by a partner. According to testimony from former employees, the firm's office atmosphere was anything but conventional.
