Court Explaining $4.1M Fees Award in Kia Class Action Excoriates Defense Witness
In a supplemental opinion supporting his $4.1 million fees award in a Kia Motors faulty brake class action, Philadelphia Common Pleas Judge Mark I. Bernstein excoriated testimony by a defense witness on attorney fees. Bernstein wrote, "The professional witness testifying without integrity, saying whatever their masters pay them to say, makes a mockery of the integrity of our system of justice." The fees issue is on appeal before the state Superior Court, which ordered the supplemental opinion.Pa. High Court Sides With Lenders Over Arbitration Agreements
A majority of the Pennsylvania Supreme Court has ruled in favor of the sub-prime lending industry's right to set up loan agreements that force consumers to arbitrate disputes, but allow lenders to initiate foreclosure proceedings in court. The majority held that such agreements are not presumptively unconscionable under state law.
