Judge's Nod Clears Way for Merger of Exchanges
A Manhattan judge has approved an unusual settlement that will clear the way for a vote today on the merger of the New York Stock Exchange with Archipelago Holdings Inc., a competing electronic exchange. The combination, which is expected to be approved by NYSE seatholders, will convert the world's largest stock market from a nonprofit entity into a public corporation. Several dissenting seatholders had objected, charging that the deal overvalues Archipelago. For the antitrust bar, the ruling is an important clarification of Twombly pleading standards in Sherman Act cases. And for the rest of us, it raises the possibility of cheap music downloads somewhere down the road.

Jim Rocap III, partner at Steptoe & Johnson in Washington, D.C., has represented Virginia death row inmate Teresa Lewis since 2004. But this week the appeal's final avenues were closing: Virginia's governor refused to grant clemency twice, and late Tuesday the U.S. Supreme Court denied Lewis a stay of execution by a 7-2 vote, rejecting Rocap's petition for certiorari.
