Defense Win in 'Apology Note' Med-Mal Case

A Pennsylvania jury has returned a defense verdict in a failure-to-diagnose case brought by a woman who later died of colon cancer at the age of 81. Prior to the suit, gastroenterologist William Mahood had written a letter to Meye Blom in which he apologized that a colonoscopy had failed to identify her ultimately fatal tumor. "I tried my best but clearly missed this tumor. I hope you can forgive me," he wrote. Mahood's attorney said his client didn't write the letter "to prevent litigation."

New Century trustee files suit against KPMG, alleges $1B in damages

The trustee of the failed New Century Financial Corp. has filed two lawsuits alleging at least $1 billion in damages against KPMG LLP and KPMG International for failing to perform duties as outside auditors to the company. According to the suit, KPMG LLP failed to serve as a watchdog to aggressive accounting methods that forced New Century to restate its financial reports. By then, outstanding repurchase requests had reached $8 billion, and the stock price of New Century, which had run out of financing options, plummeted 90%.
