Texas Supremes Deny Republicans' Mandamus Writ

Without comment, the Texas Supreme Court has denied a petition for writ of mandamus sought by Republican state officials in an effort to force 11 Democratic state senators who fled to New Mexico back to the state Senate to work on congressional redistricting. The court's action came about 2 1/2 hours after Democrats argued that the state's highest civil court lacks jurisdiction to consider such a mandamus.

The popular video-sharing site YouTube deleted nearly 30,000 files after a Japanese group complained of copyright infringement. The Japan Society for Rights of Authors, Composers and Publishers, found 29,549 video clips such as television shows and music videos posted on YouTube's site without permission, an official from the group said last week. Some have suggested the startup eventually could be sued by copyright holders, especially with deep-pocketed Google about to buy it for $1.65 billion in stock.

ACC Celebrates Two Wins on Privilege

The Association of Corporate Counsel celebrated two key developments last month in the protection of attorney-client privilege in government investigations. A 2nd Circuit ruling supporting the rights of corporate defendants to have unfettered access to counsel in a case involving former KPMG partners and new corporate prosecution guidelines issued by the Department of Justice dealt a death blow to the "Thompson memo."
