Calif. Appeal Court Unties Two Asbestos Suits

A San Francisco Superior Court judge who combined two asbestos suits for trial in front of one jury will have to conduct separate trials. In an unpublished ruling, a California appellate court ordered the lower court judge to vacate an order consolidating a living plaintiff's kidney cancer suit with a dead plaintiff's mesothelioma suit. Looking at eight criteria, the appeal court found that only one supported consolidation -- the same attorney represented all the plaintiffs.
