Philadelphia Housing Authority Not Liable for Dog Attack on Child Tenant

The Philadelphia Housing Authority enjoys sovereign immunity from a suit brought by a tenant who allegedly suffered injuries when attacked by another tenant's pit bull, an en banc panel of the Pennsylvania Commonwealth Court has ruled. Though the dog was tethered to a tree in a development common area and the PHA had been told about concerns that the dog was not properly attended, the court found it lacked care, custody and control of the animal.
